Fomo Terms of Service

Welcome to Fomo.

Fomo is a social map for real-life moments: the spontaneous ones, the planned ones, the “you had to be there” ones, and the ones you’ll want to remember later.

We built Fomo so friends can see what’s happening, join each other IRL, create shared moments, and turn them into memories.

These Terms of Service are here to explain the rules of the game. We tried to keep them readable, but yes, they are still legal terms. By creating an account or using Fomo, you agree to them.

These Terms apply to Fomo’s mobile apps, websites, software, features, content, and related services. We call all of that the “Services.”

The Services are provided by Topdeck, a French société par actions simplifiée, registered under SIREN 104 892 740, with its registered office at 47 rue Vivienne, 75002 Paris, France (“Fomo,” “Topdeck,” “we,” “us,” or “our”).

If you do not agree with these Terms, you should not use Fomo. No hard feelings.

1. Who can use Fomo

Fomo is for people who are old enough to use a real-life social app responsibly.

You must be at least 13 years old to create an account or use Fomo. If the laws of your country require you to be older, or require parental or guardian consent, then those rules apply too.

By using Fomo, you confirm that:

Fomo is for real humans sharing real moments. No bots, fake accounts, scrapers, automated accounts, AI agents, or weird shadow tools. Be a person.

2. Your account

To use Fomo, you need an account.

At launch, you can sign up using email, Google Sign-In, Apple Sign-In, or other sign-in methods we make available. Then you choose a username or nickname.

You do not need to use your legal first name or last name for now. Nicknames are okay. If we ever change that for a specific feature, we’ll make it clear.

Your account is yours. Please keep it that way.

3. Account security and messages from us

Please keep your account and device secure. Fomo is social, location-based, and full of memories, so account security matters.

We may send you messages about your account, security, moderation decisions, product updates, legal notices, support, or important changes to Fomo.

Because Fomo does not currently use phone number sign-up, we will usually contact you through the app, email, push notifications, or the sign-in provider you used.

4. Location: the whole point, but not a free-for-all

Fomo is built around the map. Location is what makes a moment feel alive.

But we do not continuously track your live location. You will see a geo-localization button; the position it uses comes from your phone and is not stored — we do not see that data.

At launch, we use your device location mainly when:

When you post a photo, GIF, video, moment, fomo, event, or memory, we may store the coordinates linked to that content so the feature works properly.

If you do not allow location access, you may still be able to see what your friends are up to. But you probably will not be able to post moments, join fomoes, or use other location-based features.

You can turn location permissions on or off in your device settings.

Important: do not use Fomo to stalk, track, monitor, harass, intimidate, or endanger anyone. That is not Fomo. That is creepy, unsafe, and not allowed.

Misusing location features can get your content removed, your account restricted, your account banned, or, in serious cases, reported to the proper authorities.

5. Friends, close friends, and who gets to see what

Fomo is not about shouting to the whole internet. It is for you and your friends.

A “friend” is someone you accepted as a friend on Fomo.

When you post or create something, Fomo may let you choose who can see it. At launch, this can include:

Your close friends list may be based partly on your interactions and friends list, but you can adjust it where the feature is available.

Friends of friends are not automatically your friends. They generally cannot see your moments.

There is one important exception: if your moment becomes a fomo, friends of other users who joined that fomo may be able to see the fomo if the visibility settings allow it. That is because a fomo is a group moment, not just your solo moment anymore.

The original poster of a moment controls certain privacy settings for that moment and may decide whether to remove or expand the initial privacy group where that feature is available.

Choose your audience carefully. The “send it” feeling is fun. Regret is less fun.

6. Contacts and friend recommendations

Fomo may ask for access to your contacts to help you find friends or invite people you know.

You can control contact permissions in your device settings.

Fomo may also recommend friends based on friend connections, mutual friends, or activity on the Services.

At launch, Fomo does not show ads and does not use personalized advertising.

Please do not use invitations, friend requests, comments, chats, or any other Fomo feature to spam, harass, pressure, or mislead people.

7. Moments

A “moment” is a photo, GIF, video, or group of content that you post and that may appear on the map depending on your visibility settings.

Moments are made to be fresh. They are not meant to live forever.

Unless a moment becomes part of a fomo that later becomes a memory, moments disappear from the map after about 24 hours and are deleted from our active database after that period.

There may be limited exceptions where we need to keep something for legal, safety, security, moderation, or technical reasons, as explained in our Privacy Policy.

You can delete your own moment where the feature is available.

8. Fomoes

A “fomo” is what happens when a moment becomes a shared experience.

Fomoes are not created automatically just because people are standing in the same place. You have to actively join. Consent matters. So does actually being there.

At launch, the process may work like this:

To join a fomo, you may need to be within the required location perimeter, currently around 100 meters, and meet the visibility and friendship requirements.

If the original moment was shared with a limited group, only that group can initially see and join the fomo, unless the original poster changes the privacy group where that feature is available.

You may leave a fomo and rejoin where the feature allows it. If you leave, the photos, GIFs, videos, and other content you posted in that fomo may be removed.

9. Events

Fomo also lets you plan things before they happen. Very responsible of you.

An “event” is a promise of fun with a date, time, and place. You can invite selected people or open it to all your friends, depending on the available settings. One week prior to the event, a marker will appear on the map.

Only invited users, or users included in the selected visibility group, can see the event marker.

When the event date and time arrives, and eligible users are at the right location, the event may turn into a fomo.

The fomo generally keeps the same visibility rules as the event. This means invited users may continue to see the fomo, including users who declined the invite, depending on the available settings.

Please create events responsibly. Do not create events that encourage trespassing, illegal activity, harassment, dangerous behavior, unsafe gatherings, or anything that would make your parents, our lawyers, or the police ask questions.

10. Memories

A “memory” is what a fomo becomes after the active moment is over.

Memories are for the people who were actually there and joined the fomo. We may call them “goers.”

People who only watched or interacted remotely with a fomo may be called “fomoers.” Fomoers cannot access the memory once the fomo becomes a memory.

A memory is a group memory. One person cannot delete the whole memory for everyone. That would be unfair and honestly a bit dramatic.

You can leave a memory where the feature is available. If you leave, the photos, GIFs, videos, messages, voice messages, or other content you posted in that memory may be removed, subject to limited legal, safety, security, or technical retention.

If you delete your account, the pictures, GIFs, videos, and other media you posted will be deleted in accordance with our Privacy Policy. Your chat messages may be deleted or anonymized. For example, they may appear as coming from “Anonymous” with placeholder text such as “….” if needed to preserve the continuity of a group memory or conversation.

Memories are designed to last, but we cannot promise that any memory or content will be available forever. Technical problems, legal requirements, moderation decisions, account deletion, or other issues may make content unavailable.

Please keep your own backup of anything you really care about.

11. Chat, comments, and voice chat

Fomo may let users chat, comment, react, request photos, send voice messages, or interact with moments, fomoes, and memories.

At launch, chat exists only inside fomoes and memories. Fomo does not currently offer general direct messages.

Inside a fomo, users may have different roles:

Goers may be able to talk only to other goers or to everyone in the fomo. Fomoers may be able to chat only with everyone.

Where goer-only chat is available, fomoers may see blurred or hidden message bubbles instead of the actual message. Yes, that means there may be conversations you know exist but cannot read. That is part of the feature.

When a fomo becomes a memory, chat may remain available to the memory participants. Since memories are only for goers, fomoers will no longer be able to see or interact with the chat.

Voice chat may follow the same visibility rules as text chat.

Users may also comment on moments. Comments may be visible to the relevant audience for that moment, fomo, or memory depending on the feature and visibility settings.

Use chats, comments, requests, and voice messages like a normal decent human. Do not harass, threaten, pressure, shame, stalk, exploit, deceive, or manipulate people.

12. Your content

“Content” means anything you create, upload, post, send, receive, display, store, or share through Fomo.

That includes photos, GIFs, videos, usernames, profile information, captions, comments, messages, voice messages, location-based posts, moments, fomoes, events, memories, reactions, requests, and anything else you put into Fomo.

You own your Content. We do not magically become the owner of your selfies, inside jokes, event plans, or memories.

But we do need permission to use your Content so Fomo can work.

When you use the Services, you give Fomo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, display, publish, transmit, process, modify, adapt, and distribute your Content for the purpose of operating, providing, securing, developing, improving, and promoting the Services.

For Content shared only with selected friends, close friends, event invitees, fomo participants, memory participants, or other limited audiences, our license is limited to what is needed to provide, secure, maintain, and improve Fomo, including showing that Content to the people who are allowed to see it.

If Fomo later offers public sharing and you choose to make Content public or visible to a broad audience, you give Fomo a broader license to display, distribute, promote, and make that Content available through the Services and related channels, without compensation to you, subject to applicable law and your settings.

You also allow other users to view and interact with your Content as permitted by your visibility settings and by Fomo’s features.

If you send us feedback, ideas, suggestions, or comments, we may use them without paying you or owing you anything. We will probably be grateful though.

13. Your responsibility for Content

You are responsible for what you share.

By posting Content, you confirm that:

Basically: be fun, not harmful.

Fomo has zero tolerance for objectionable content and abusive users. Content that violates these Terms, and the accounts responsible for it, may be removed, restricted, or banned.

We may remove, restrict, or report Content if we believe it violates these Terms, our policies, or the law.

14. Downloading, deleting, and controlling your Content

Where available, you can delete your own comments, chats, pictures, GIFs, videos, moments, and other Content.

Where available, you can download your own pictures, GIFs, videos, or other media.

You may not download, copy, save, reuse, publish, or distribute another user’s Content outside Fomo unless you have their permission or a legal right to do so.

Deleting Content may not instantly remove every technical copy from backups, logs, moderation systems, security systems, or legal preservation systems. We handle deleted Content as explained in our Privacy Policy.

15. Reporting, blocking, and moderation

We want Fomo to feel safe. Fun dies quickly when people behave terribly.

Users may report Content, comments, chats, voice messages, pictures, GIFs, videos, accounts, moments, fomoes, events, memories, or other activity that they believe violates these Terms or the law.

At launch:

Blocking another user may limit or prevent interactions between you and that user. Blocking may not remove all prior interactions, group content, memories, or records where we need to keep them to provide the Services, protect users, or comply with law.

We may review reports using human review, automated tools, or both.

Depending on the situation, we may:

We are not required to review everything before it is posted, but we may review, moderate, restrict, or remove Content when we believe it is necessary.

16. Moderation decisions and appeals

If we remove your Content or restrict your account, we will try to tell you and explain why, unless we are legally prohibited from doing so or believe notice would create a safety, security, or legal risk.

You may appeal a moderation decision where the feature is available, or by contacting guillaume@fomoapp.eu.

Please include your account information, the decision you are appealing, and any useful explanation.

We will review appeals in a timely, fair, and non-arbitrary way. If we got it wrong, we may reverse or change our decision.

Some violations are too serious for a warning. Severe violations may lead to immediate permanent suspension. This includes child sexual abuse material, credible threats of violence, non-consensual intimate imagery, stalking, serious harassment, serious misuse of location features, or attempts to endanger another person.

17. Real-world safety

Fomo is about going out, seeing friends, and remembering good times. It is not a reason to do something stupid.

Do not use Fomo while driving, cycling, riding a scooter, crossing the street, or doing anything that requires your attention.

Do not trespass, enter dangerous places, disturb people, break venue rules, or put yourself or others at risk to create Content, join a fomo, attend an event, or appear on the map.

You are responsible for your real-world interactions with other users. Fomo does not organize, supervise, verify, or control user gatherings unless we clearly say otherwise for a specific official event.

18. Respecting Fomo’s rights

Fomo and its licensors own the Services, including the app, software, source code, design, interface, features, trademarks, logos, branding, systems, databases, and technology.

We give you a personal, limited, worldwide, non-exclusive, non-transferable, revocable, and non-sublicensable license to use Fomo for your personal, non-commercial use, in accordance with these Terms.

You must not:

19. Scraping and automated access

Do not scrape Fomo.

You may not use bots, spiders, crawlers, scrapers, scripts, browser extensions, AI agents, automated systems, or similar tools to access, copy, extract, monitor, or collect data from Fomo without our prior written permission.

You may not use Fomo data, user Content, location data, profile data, social graph information, event data, map data, or other information from the Services to train, develop, or improve artificial intelligence models, machine learning systems, analytics products, or competing services without our written permission.

20. Privacy

Your privacy matters. Especially on a location-based social app.

Our Privacy Policy explains what information we collect, how we use it, how we share it, how long we keep it, and what rights you may have.

Because Fomo uses location-based and social features, please read the Privacy Policy carefully.

By using Fomo, you understand that we process information as described in our Privacy Policy, including information needed to provide map-based features, moments, fomoes, events, memories, account security, moderation, analytics, and support.

21. Paid features and in-app purchases

Fomo does not offer paid features at launch.

In the future, Fomo may offer paid features, subscriptions, digital items, premium tools, storage options, event tools, map features, memory features, or other paid services.

If paid digital features are offered in the iOS app, purchases will be processed through Apple’s App Store where required. If paid digital features are offered in the Android app, purchases may be processed through Google Play or another authorized payment provider where required.

Prices, billing periods, renewal terms, cancellation options, and refund rules will be shown before purchase.

App Store and Google Play payment and refund rules may apply. We do not control Apple’s or Google’s payment systems.

Unless required by law or by the applicable app store rules, paid digital features may be non-refundable once provided, consumed, or activated.

If we introduce paid features, we may publish additional paid-features terms.

22. Advertising and recommendations

Fomo does not show ads at launch.

Fomo may recommend friends based on friend connections, mutual friends, or activity on the Services.

If we introduce ads, personalized advertising, sponsored content, or broader recommendation systems in the future, we will update our Privacy Policy and, where necessary, these Terms.

23. AI features

Fomo does not offer user-facing AI features at launch.

No AI captions, AI-generated photos, AI chatbots, or AI pretending to be your friend. Just people you know and the content they choose to share.

We may use technical tools to operate, secure, moderate, or improve the Services, as explained in our Privacy Policy.

If we introduce user-facing AI features in the future, we may update these Terms or provide additional terms.

24. Third-party services

Fomo may use third-party services to make the app work. This can include hosting providers, analytics tools, authentication providers, map providers, cloud infrastructure, crash reporting tools, app stores, payment processors, content delivery networks, and other technical partners.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services, content, terms, actions, or availability, except where applicable law says otherwise.

25. Changes to Fomo

We are going to keep building. That means Fomo will change.

We may add, remove, suspend, limit, modify, or discontinue features or parts of the Services at any time.

We may also stop providing the Services entirely. We hope not. But legally, we have to say it.

Where reasonable, we will try to notify users in advance, but we cannot guarantee advance notice in every situation.

26. Changes to these Terms

We may update these Terms from time to time.

If changes are material, we will try to give reasonable notice before they take effect, such as through the app, email, or another appropriate method.

If you keep using Fomo after updated Terms take effect, you agree to the updated Terms.

If you do not agree, you must stop using Fomo and may delete your account.

27. Account deletion, suspension, and termination

You can stop using Fomo at any time.

You may delete your account through the app settings where available, or by contacting us at guillaume@fomoapp.eu.

If your account is deleted or terminated, your right to use Fomo ends immediately.

Some sections of these Terms continue to apply after your account is closed, including sections about Content licenses, intellectual property, moderation, disclaimers, limitation of liability, indemnity, dispute resolution, and general legal terms.

28. Disclaimers

We will try very hard to make Fomo work well. But we cannot promise perfection.

The Services are provided “as is” and “as available.”

To the maximum extent permitted by law, Fomo makes no warranties, express or implied, about the Services, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or reliability.

We do not guarantee that:

You may encounter Content that is offensive, inaccurate, illegal, misleading, or inappropriate. We are not responsible for user Content, except where applicable law says otherwise.

Nothing in these Terms limits rights you may have under mandatory consumer protection laws.

29. Limitation of liability

To the maximum extent permitted by law, Fomo, Topdeck, and their founders, directors, officers, employees, contractors, affiliates, licensors, suppliers, and agents will not be liable for indirect, incidental, special, consequential, punitive, or multiple damages, or for loss of profits, revenue, data, use, goodwill, reputation, or other intangible losses arising from or related to:

To the maximum extent permitted by law, Fomo’s total liability for any claim relating to the Services will not exceed the greater of €100 or the amount you paid to Fomo in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where it cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or mandatory consumer rights.

30. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Fomo, Topdeck, and their founders, directors, officers, employees, contractors, affiliates, licensors, suppliers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:

31. Dispute resolution

We would rather talk than fight in court.

If you are acting as a consumer in the European Union, you may have rights under mandatory consumer protection laws, including the right to bring a claim before the courts of your place of residence where applicable.

32. Governing law and jurisdiction

These Terms are governed by the laws of France, unless the laws of your country of residence require otherwise.

To the extent legally permitted, disputes arising out of or related to these Terms or the Services will be brought before the competent courts of Paris, France.

If you are an EU consumer, you may bring proceedings either before the competent courts of Paris or before the courts of the place where you are domiciled, where required by applicable law.

33. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary.

The rest of the Terms will still apply.

Our lawyers survive. The Terms survive. Everyone moves on.

34. General terms

These Terms, together with our Privacy Policy and any additional terms that apply to specific features, make up the entire agreement between you and Fomo regarding the Services.

These Terms do not create third-party beneficiary rights.

If we do not enforce part of these Terms, that does not mean we waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our permission.

We may transfer our rights and obligations under these Terms in connection with a merger, acquisition, financing, restructuring, sale of assets, or by operation of law.
